The upcoming constitution, on which the vote on its articles is taking place in the Constituent Assembly, came up with countless mockeries and terrifying violations of the divine rules, and angers Allah in defiance and explicit aggression, on this Ummah’s firmly established legislation, ideology and civilization.
1. Methodologically: this Constitution is a mixture of fabrications, adjustments, and compromises in the name of compatibility between obscure ideologies that do not exist in the people and the Ummah, but are a Western vocal and supportive.
2. This constitution with thousands of evidences is under the pressure of the West and its sponsorship; not only by creating the terrorist incidents, but also supervising the formulas and words, and the endorsement and displacements. It is a sponsorship that inhabits the offices of the Constituent Assembly with the acclaimed crime.
3. A constitution that is strenuously keen to exclude all that is Islamic; rather it deliberately creates a situation for the removal of Islam even in the details of public relations, and country and people’s affairs in what is right and just.
4. In this constitution the fate of the country is thrown into the legislative and political unknown, disdaining and overriding this revolution, its good people and this precious Ummah. These articles are introductions to balloting laws concerning our money, our offerings, our religion and the future of our children. There will be a field for disputes, conflicts and interpretations in light of this disgraceful and deceit Constitution.
This Constitution had lost the country three pillars of its pride and dignity:
1. Sovereignty is for the Shari’ah: so that Islam is to determine the interest and specifies the rights and duties. This Constitution disregards what is known of the religion by necessity; the doctrine (Aqeeda) of Islam from which system emanates (in obedience to Allah and His Messenger).
2. Authority belongs to the Ummah, thus choosing or election would be false and deceptive within the circle of secularism; between a secular and another, between one manmade law and another one like it, and between one who is keen on this evil constitution and another who is keener.
3. The security of Muslims is in their hands: There is nothing in this constitution that confirms the dominance of the state; Thus in the name of universal laws, international agreements, conciliation and making peace, this Constitution avoided the mentioning of anything that prevents penetration and loyalty to the foreigner or making reference to “Israel” and Zionism. Rather, nothing in the Constitution prevents plundering the wealth of the country under various titles…. in a coward treason legislative work.
We hold the Constituent Assembly individually and in particular those who are in presidency the responsibility before Allah, and we complain of them to the Lord of the Glory, who says,
فَلَا وَرَبِّكَ لَا يُؤْمِنُونَ حَتَّىٰ يُحَكِّمُوكَ فِيمَا شَجَرَ بَيْنَهُمْ ثُمَّ لَا يَجِدُوا فِي أَنْفُسِهِمْ حَرَجًا مِمَّا قَضَيْتَ وَيُسَلِّمُوا تَسْلِيمًا
“No, by your Lord, they are not believers until they make you their judge in the disputes that break out between them, and then find no resistance within themselves to what you decide and submit themselves completely.”
(An-Nisa: 65)
And says:
وأن احكم بينهم بما أنزل الله ولا تتبع أهواءهم واحذرهم أن يفتنوك عن بعض ما أنزل الله إليك
“Judge between them by what Allah has sent down and do not follow their whims and desires. And beware of them lest they lure you away from some of what Allah has sent down to you.”
(Al-Ma’ida: 49)
