The Houthi militias are still detaining five of the Shabab of Hizb ut Tahrir for more than a week, in which these Shabab were unjustly and oppressively arrested on the Khawlaan road to Sana’a. No charge has been levelled against them apart from that they are affiliated to Hizb ut Tahrir which works exerting itself to revive the Ummah by the Shariah method which does not employ material physical acts and does not incite Fitnah and infighting. Rather it is the method that follows the Seerah of the Prophet ﷺ when he established his State, hand span by hand span, arm span by arm span, until the objective is accomplished, which will be soon by Allah’s permission. These Shabab are Brother Engineer Shafeeq Khamees, Brother Abdullah Al-Qaadi, Member of the Hizb Media Office in Wilayah Yemen who was detained alongside his son Ali Abdullah Al-Qaadi, in addition to Brother Muhsin Al-Ja’dabiy and Brother Abdul Kareem Assda’ii. The families of the detained went to look into the matter of the detention of their loved ones in an attempt to get them released and some of the Shabab of the Hizb assisted them in this but to no avail. This is despite the head of the ‘High Revolutionary Council’ Muhammad Ali Al-Houthi having ordered the release of those detained when one of their relatives visited him. However we do not know why this arbitrariness is being undertaken by the prison officials?!! This can only mean one of two things; either a flaw existing between the leadership and its followers which has caused them not to implement their orders or the speech of a leader which is just a manoeuvre, deceit and lie, whilst both of these possibilities are bad enough. On top of this, all those who were communicating with the prison officials mentioned some points that the officials were protesting and wanted to clarify from the Hizb due to some ambiguities that they had. In the backdrop, they continued their arbitrariness and stalled the release of the detained Shabab of the Hizb. And now in this statement we will make clear to them so that they may become aware:
So in respect to the black Rayah (Banner) that the Hizb raises, it is a Rayah that has its Shariah Daleel (evidence). This is because it has been confirmed that the Rayah of the Messenger of Allah ﷺ was black and his Liwaa (flag) was white. Ahmad, Abu Dawud and An-Nasaa’i in his ‘Sunan Al-Kubraa’ related from Younus Bin Ubaid the Mawla of Muhammad Bin Al-Qaasim that he said: Muhammad Bin Al-Qaasim dispatched me to Al-Baraa’ Bin ‘Aazib to ask him about the Raayah (banner) of the Messenger of Allah ﷺ and what it was? So he said: “It was black squared from Namirah”. At-Tirmidhi and Ibn Maajah related from Ibn ‘Abbaas that he said: “The Raayah of the Messenger of Allah ﷺ was black and his Liwaa was white.” And in some of the narrations it was mentioned that Laa Ilaaha Illallah Muhammadur Rasoolullah was written upon it and so At-Tabaraani in ‘Al-Awsat’ related from Ibn ‘Abbaas that he said: “The Rayah of the Messenger of Allah ﷺ was black and his Liwaa was white. It was written upon it: Laa Ilaaha Illallah Muhammad ar-Rasoolullah.” As such the Hizb has adopted this Rayah and the writing of the two Shahaadahs upon it since the time of its initial establishment in 1953 in Bait ul-Maqdis and so should it be taken to task for this or criminalised?!! Indeed, so bring the evidence that prohibits the raising of that Rayah if indeed you have any understanding. Or is it that you not read His سبحانه وتعالى Words,
لَّقَدْ كَانَ لَكُمْ فِي رَسُولِ اللَّـهِ أُسْوَةٌ حَسَنَةٌ لِّمَن كَانَ يَرْجُو اللَّـهَ وَالْيَوْمَ الْآخِرَ وَذَكَرَ اللَّـهَ كَثِيرًا
“Indeed in the Messenger of Allah you have a good example to follow for him who hopes in (the Meeting with) Allah and the Last Day and remembers Allah much.”
(Al-Ahzab: 21)
And His Subhaanahu Speech:
وَإِن تُطِيعُوهُ تَهْتَدُوا
“And if you obey him you will be guided”
(An-Nur: 54)
Or is all of this only for the purpose of exaggerating the matter?! As for the relationship of the Hizb with armed organisations like Al-Qaa’idah, Jubhat An-Nusrah and others, then in respect to this the Hizb has clarified in more than one statement that it has no relationship to those organisations. Rather it views them in the same way that it views other Islamic movements which includes the Houthi movement which has called itself the ‘Ansaar (supporters) of Allah’. All of them in the view of the Hizb are Muslims because the Hizb does not take a view except from the perspective of Islam. So it doesn’t look at it from a sectarian or school of thought (madh’hab) perspective or from the viewpoint of any other narrow invalid bonds like nationalism and patriotism. In spite of the existence of thoughts within them which are contrary to Islam they are not however of the level that would make the Hizb declare its followers as disbelievers (and this is not the type of action that the Hizb undertakes). We also do not consider them to be enemies but rather the Hizb is bonded to them by the bond of the Aqeedah and the brotherhood of Islam, even if they transgress and act unjustly. It is as the Ameer ul-Mu’mineen ‘Ali (ra) said in respect to those who fought him and rebelled against him: ‘They are our brothers who have rebelled against us’. The Hizb explains to these groups, advises them and warns the Ummah in respect to what these un-Islamic understandings are pulling it towards in relation to the process of destroying the Ummah and serving the disbelieving colonialist. All of this happens within the etiquettes of difference of opinion as long as these thoughts are within the issues of Ijtihaad.
Indeed it is very shallow for anyone to think that the Hizb has a relationship with Jubhat An-Nusrah in Ash-Shaam or any other armed group or that it is part of it merely because the Raayah that they both raise is similar?!! This is because the Hizb was established before these organisations by decades and throughout all that time it has not been proven that it has violated its method that it has adopted and which does not undertake material actions. So it does not take up arms in its method for change but rather it only follows the Shariah method that the Prophet ﷺ proceeded upon in respect to the establishment of his state, when he established the state in Al-Madinah Al-Munawwarah, whilst the Ahkaam of Al-Jihaad and fighting had not yet been revealed. This method begins with the Takattul (structuring) and culturing and then moves on to interaction with the society by way of the intellectual clash, political struggle and seeking the Nusrah. This is followed by the stage of acquiring the rule from the Ummah by those who are the people of power amongst them. And here now we have the Hizb calling to the people of power and striving to take the Nusrah (support) from them upon Islam and the establishment of the rightly guided Khilafah. So it addresses these armed groups so that they respond positively to its objective which is the objective of the Ummah. It therefore addresses Jubhat An-Nusrah in Ash-Shaam and other groups just as it addresses the Houthis in Yemen and others aside from the Houthis. As such discussion have taken place between the Shabab of Hizb ut Tahrir in the Wilayah of Yemen and many of the Houthis, at the head of which was As-Sayyid Badr Ad-Deen Al-Houthi (May Allah’s mercy be upon him). This is when the Hizb sent a delegation that visited him in Sa’adah and presented to him the project of the Khilafah. The discussions that took place were sophisticated, restricted by the Ahkaam of Islam and observed that which it is permitted to have difference of opinion in and that which it is not permitted to differ in. This is what led As-Sayyid Badr Ad-Deen Al-Houthi to value the strength of what the Hizb was presenting whilst in his fervent desire to see the ideological unifying of the Muslims, he showed his readiness to give the Bayah in the case where the Hizb was to establish the Khilafah upon the methodology of the Prophethood, yet he returned to his Rabb and Allah is his Wakeel.
As for the stance of the Hizb in respect to the war in Yemen, then the Hizb has made clear on more than one occasion whether this was in its leaflets, its statements or in the answer provided by its Ameer, the eminent scholar Ata Bin Khalil Abu Rashtah (Hafizhahullah). In all of this the Hizb has made clear that the struggle over Yemen is an international struggle. It is an Anglo American struggle that is being steered by the colonial West with its regional and unfortunately its local tools. So the Hizb arose to warn the people of Yemen of being drawn into the struggle, its states and tools whilst explaining to them the danger of its rotten sectarian dressing. It made clear that fighting and killing between Muslims is not permissible whether this fighting was internal or by the states of the region whilst warning of the consequences of these wars and the Fitnah that they bring. Similarly we warned about the United Nations and their envoys and conferences or rather their conspiracies. The Hizb was alone in respect to adopting the stance and position of Islam and was like the plain warner and leader who does not lie to its people. This position was not adopted to please one side at the expense of another, rather it is a stance that seeks the pleasure of Allah and raising His word highest through the establishment of the rightly guided Khilafah upon the methodology of the Prophethood.
In respect to your claims that we are inciting against you!! Then if this represents an incitement towards killing and fighting, then bring your evidence and prove it if you are being truthful. Our publications and statements are all available so go through them on the official web page of Hizb ut Tahrir and bring to us proof of what you claim. However, in truth, your problem is that any description of your situation or exposure of what we see of you oppression or any criticism of your thought or even just advise which is provided to you, is treated and considered by you to represent and incitement being made against you. This is despite our publications and statements deals with the political aspect related to the actions of the rulers, the political movements and the politicians who have a negative influence and effect upon Islam and the Muslims whilst they are not sectarian or Madh’habiyah (of a school of thought). So why are you so sensitive to our statement that Iran serves the American policy at the same time that we expose the agency of the Saudi family and others rulers, explaining that they are agents to America and others. Similar to this is the agency of those who go along with these states who have no concern for Islam or the Muslims. We have advised you and we have advised others as well to not attach yourselves to these client regimes which will take you to the western colonialist camp and its United Nations, which are against Islam and the Muslims. However it appears to us that you are not of those who like those who provide advice!!
O Houthis: Have you got it in you to be the Ansaar (supporters) of Allah in truth so that you will discard your blind attachment to your fathers and grandfathers if they were wrong and then respond to the call of truth and be Ansaar (supporters) of Islam in truth followed by working alongside Hizb ut Tahrir to establish the rightly guided Khilafah upon the methodology of the Prophethood? Or can this not be hoped for from you because you have already discarded all of that behind your backs and as a result your names and titles do not hold any meaning?!! Or are they merely empty slogans and hollow cries? Here you are making alliances with the oppressors who have oppressed you for years and you let free Americans aggressors. This is whilst you act arbitrarily in respect to releasing the oppressed Muslims including the Shabab of Hizb ut Tahrir who are imprisoned by you without crime or charge apart from that which you are unclear about according to you claims in respect to the Hizb and its methodology… Know that our invitation to you is more merciful to you as compared to some of you who are taking you to destruction. There is a huge difference between the call to the rightly guided Khilafah upon the methodology of the Prophethood and between the call to a secular civil republican state. Just as there is a great difference between those who invite you the Geneva conference and between those who invite you towards a clear and pure project and object that emanates from the pure Islam. You need to know that the repression and harassment will never divert the Hizb from its Da’wah just as imprisonment and other styles employed by the tyrants, which you yourselves have tasted before, will have no effect. However you did not take heed and have made allied yourselves with the jailers and have now come to adopt the exact same path. This is whilst you have not provided Islam and the people of Yemen their due and considered right!
وَاللَّهُ لَا يُحِبُّ الظَّالِمِينَ
“And Allah does not love the oppressors”
