The proposed constitutional amendments project in Parliament, have permitted the marriage between a male and a female through direct consensus and contract or through delegation (Wikala) after reaching the legal age of maturity. The head of the Emergency Committee for Reviewing the Constitutional Amendments, Badriya Sulaiman, has announced the invitation to the Body of Sudanese Ulema, the National Intelligence and Security Apparatus, the Constitutional Court and the Higher Judiciary and law officials, to listen to their views on the amendments. These amendments dropped the guardian’s consent in marriage, and gave the woman the right to get herself married without the consent of her guardian, and this is contrary to the Shariah law, for His ﷺ saying: «أَيُّمَا امْرَأَةٍ نَكَحَتْ بِغَيْرِ إِذْنِ وَلِيِّهَا فَنِكَاحُهَا بَاطِلٌ» “Any woman who gets married without the permission of her wali (guardianship), then her marriage is void”.
The present amendments are made to conform to the National Dialogue outputs; the American project for the secularization of the country, explicitly, and to remove Islam from the last strongholds in Sudan with regard to the relations it organizes; the marriage relationship!
O Muslim Women:
These are the fruits of America’s project in Sudan (the National Dialogue); the abolition of the guardianship of marriage, and it is the opening of the wide door for ‘Urfi (customary) marriage and the likes, so do not remain silent over this heinous evil, which destroys the cohesion of the family, and is the spread of immorality and vice in society and legalizing it!!
Marriage is one aspect of life that is organized by the rules of Islam, and Islam made it sacred, and it considers it as an action of obedience that allows man to draw near to the Creator, Islam has put down the conditions and the foundations of marriage, and called its contract a solemn covenant.
The government through these amendments relating to marriage opens the door widely to create the atmosphere, and pave the way for acceptance of the immorality convention (CEDAW). But it will fail, with Hizb ut Tahrir’s work, day and night to demolish the Kaffir colonizer’s projects and tools, and to establish the Ummah’s a project, the righteous Khilafah (Caliphate) on the Method of Prophethood, which will implement the Shariah, and establish pure and chaste societies.
وَأَنَّ هَذَا صِرَاطِي مُسْتَقِيمًا فَاتَّبِعُوهُ وَلا تَتَّبِعُوا السُّبُلَ فَتَفَرَّقَ بِكُمْ عَنْ سَبِيلِهِ ذَلِكُمْ وَصَّاكُمْ بِهِ لَعَلَّكُمْ تَتَّقُونَ
“And, [moreover], this is My path, which is straight, so follow it; and do not follow [other] ways, for you will be separated from His way. This has He instructed you that you may become righteous”
(Al-An’am: 153)
