O Ulema of the Muslims in Pakistan! You are the heirs of the Prophets and you have a great trust placed upon you, about which you will be asked about on the Day of Resurrection. This trust is to clarify the command of Allah in all matters for the Muslims, both in public and private life alike. And this trust is to be conveyed without the fear of anyone but Allah, and without a desire for anything but the pleasure of Allah سبحانه وتعالى and His reward.

Open letter to the Ulema of Pakistan from Hizb ut-Tahrir Wilayah Pakistan
O respected and honoured Ulema of the Muslims in Pakistan! We greet you by the greeting of Islam, the greeting of the people of Paradise, السلام عليكم ورحمة الله وبركاته
The government of Zardari, the American agent, has called you to issue a fatwa about the sanctity of the blood of Muslims and condemn those who violate it. It is with respect to this that we in Hizb ut-Tahrir Wilayah Pakistan, address you in this open letter, reminding and advising you according to the Hadith of RasulAllah صلى الله عليه وسلم,
الدين النصيحة، قالوا لمن، قال لله ولرسوله ولكتابه ولائمة المسلمين وعامتهم
“The deen is advice. Then he was asked: To whom? He replied: The advice is from Allah, His Messenger and His book to the leaders of the Muslims and their common folk” (Muslims)

O Ulema of the Muslims in Pakistan! You have seen with your own eyes and you continue to see what has happened and is still happening to the Muslims in Pakistan; heinous crimes, violation of the sanctity of Muslim blood in Peshawar, Islamabad, Rawalpindi, Lahore and Multan, killing of women and children, the elderly and young people without discrimination, killing in the markets, universities and mosques and relentless bombings by the drones of the kafir Americans against the Muslims in Waziristan, where houses are collapsed upon the heads of their residents, day and night. There is no doubt regarding the sanctity of Muslim blood to Allah, and the killing of a Muslim is the greatest of sins. Allah سبحانه وتعالى said,
وَمَنْ يَقْتُلْ مُؤْمِنًا مُتَعَمِّدًا فَجَزَاؤُهُ جَهَنَّمُ خَالِدًا فِيهَا وَغَضِبَ اللَّهُ عَلَيْهِ وَلَعَنَهُ وَأَعَدَّ لَهُ عَذَابًا عَظِيمًا
“And whoever kills a believer intentionally, his recompense is Hell to abide therein; and the wrath and the curse of Allah are upon him, and a great punishment is prepared for him.” [Surah An-Nisa’a 4:93]
And according to the Hadith of RasulAllah صلى الله عليه وسلم,
أن حرمة دم المسلم أعظم عند الله من حرمة الكعبة، ومن عرضه وماله، وان لا يظن فيه إلا خيرا
“The sanctity of Muslim blood is greater for Allah than the sanctity of the Kaaba, as is his honour and his property, and thinks only good of him.”
These heinous crimes are alien to the values and morals of the Muslims in Pakistan. The Muslims in Pakistan are known purely by their deen and for the purity of their souls and good hearts. They are as far from these evil acts as the earth is from the stars, and their Taqwa prevents them from committing such heinous crimes, and their noble history attests to this.
The reality of the demons and devils who commit these crimes has become clear to anyone who has eyes. It is no longer a secret from anyone. It is the kafir Americans, the murderers of Muslims in Iraq, Afghanistan, Palestine, Somalia and other Muslim countries, with their American mercenary killer companies, Xe Services LLC (formerly known as Blackwater) and others – that are perpetrators of these heinous crimes. It is no longer a secret to anyone that they organize and plan these crimes and are standing behind them. The people saw them with their own eyes, more than once, as they roam the streets of Islamabad and Lahore, sometimes in cars with blacked out windows, at other times with forged local license plates. They have been seen wearing local style clothes in a bid to conceal themselves. The police have arrested them, more than once, in some of these cars, but then the US Embassy intervened and its agent Zardari government ordered their immediate release.
These kafir criminals would never have been able to perpetrate their heinous crimes were it not for the treachery of Zardari and his agent government for they brought them here and availed them every facility. It is because of their treachery that the Muslims in Pakistan will continue to be subjected to further crimes of murder and destruction, unless the Muslims in Pakistan eject the kuffar and their agents who conspired with them.
O Ulema in Pakistan! Indeed, the treachery of Zardari and the other American agents in government and their plotting against the blood of Muslims and their sanctities is exposed. Yet though they stand uncovered and disgraced, rather than returning to their senses and repenting to their Lord, stand alongside their Ummah and take the initiative to expel the kafir Americans, they instead want to pollute you with their crimes and make you responsible for the pure blood that has been shed and has yet to be shed. They wish to compel you by intimidation, persuasion, deception and cunning, so that you come out with Fatwa to justify their past and future crimes, thereby clearing their master America of those crimes and instead accuse the Muslims and Mujahideen, under the pretext of combating terrorism, a lame pretext that is exposed before everyone. Should you obey them they will make you responsible for all the sacred blood that they will spill and all the sanctities they will desecrate, so beware and rise against them, as the noble Ulema who proceeded you did, even if you pay for such a stand with your life, for death in obedience to Allah is better than living in disobedience to Him and the word of truth is the greatest Jihad. RasulAllah صلى الله عليه وسلم said,
إن من أعظم الجهاد كلمة حق تقال عند ذي سلطان جائر
“Indeed the greatest of Jihad is the word of truth spoken before the unjust ruler.”
And RasulAllah صلى الله عليه وسلم said,
سيد الشهداء حمزة بن عبد المطلب ورجل قام لإمام جائر فأمره ونهاه فقتله
“The master of martyrs is Hamza ibn Muttalib and the man who stands before an unjust rulers, orders and forbids him, and is killed by him.”
O Distinguished Ulema! If you were to do what they wish you to do – may Allah forbid – you will be sharing with them in their crime and helping them and the Kuffar against the blood and sanctities of the Muslims with your Fatwa. As for those of you who have fallen for the government’s deception and already fallen into sin, make repentance and boldly state the truth as compensation. And without doubt you know the magnitude of the burden of that sin!
O Ulema in Pakistan! Not only is issuing such a Fatwa a heinous crime, silence regarding it is a sin as well, for the duty of the Ulema is to state the word of truth and, as you know, concealing the truth is of the gravest of sins. Allah سبحانه وتعالى said,
إِنَّ الَّذِينَ يَكْتُمُونَ مَا أَنزَلْنَا مِنَ الْبَيِّنَاتِ وَالْهُدَى مِن بَعْدِ مَا بَيَّنَّاهُ لِلنَّاسِ فِي الْكِتَابِ أُولَـئِكَ يَلعَنُهُمُ اللّهُ وَيَلْعَنُهُمُ اللَّاعِنُونَ * إِلاَّ الَّذِينَ تَابُواْ وَأَصْلَحُواْ وَبَيَّنُواْ فَأُوْلَـئِكَ أَتُوبُ عَلَيْهِمْ وَأَنَا التَّوَّابُ الرَّحِيمُ
“Verily, those who conceal the clear proofs, evidences and the guidance, which We have sent down, after We have made it clear for the People in the Book, they are the ones cursed by Allah and cursed by the cursers. Except those who repent and do righteous deeds, and openly declare (the truth which they concealed). These, I will accept their repentance. And I am the One Who accepts repentance, the Most Merciful.” [Surah Al-Baqarah 2:159,160]
إِنَّ الَّذِينَ يَكْتُمُونَ مَا أَنزَلَ اللَّهُ مِنْ الْكِتَابِ وَيَشْتَرُونَ بِهِ ثَمَنًا قَلِيلاً أُوْلَئِكَ مَا يَأْكُلُونَ فِي بُطُونِهِمْ إِلاَّ النَّارَ وَلاَ يُكَلِّمُهُمْ اللَّهُ يَوْمَ الْقِيَامَةِ وَلاَ يُزَكِّيهِمْ وَلَهُمْ عَذَابٌ أَلِيمٌ
أُوْلَئِكَ الَّذِينَ اشْتَرَوْا الضَّلاَلَةَ بِالْهُدَى وَالْعَذَابَ بِالْمَغْفِرَةِ فَمَا أَصْبَرَهُمْ عَلَى النَّارِ
“Verily, those who conceal what Allah has sent down of the Book, and purchase a small gain therewith (of worldly things), they eat into their bellies nothing but fire. Allah will not speak to them on the Day of Resurrection, nor purify them, and theirs will be a painful torment. Those are they who have purchased error at the price of guidance, and torment at the price of forgiveness. So how bold they are (for evil deeds which will push them) to the Fire.” [Surah Al-Baqarah 2:174,175]
The Hukm Shar’I (Divine Ruling) upon you, each and every one of you, is to refuse issuing such and similar Fatwas, indeed, the Hukm Shar’i that is upon you is issuing a Fatwa to expel the kafir Americans from these pure Muslim lands and to uproot the traitors who brought them, Zardari and his government.
O Ulema in Pakistan! America is an open, hostile, kafir enemy of Muslims. The Americans plot against Muslims day and night, and they will not be pleased with the Muslims, no matter how many concessions they are granted regarding the sanctities of Muslims. Allah سبحانه وتعالى said,
وَلَن تَرْضَى عَنكَ الْيَهُودُ وَلاَ النَّصَارَى حَتَّى تَتَّبِعَ مِلَّتَهُمْ …
“Never will the Jews nor the Christians be pleased with you (O Muhammad ) till you follow their religion” [Surah Al-Baqarah 2:120]
… وَلاَ يَزَالُونَ يُقَاتِلُونَكُمْ حَتَّىَ يَرُدُّوكُمْ عَن دِينِكُمْ إِنِ اسْتَطَاعُواْ ..
“And they will never cease fighting you until they turn you back from your deen if they can.” [Surah Al-Baqarah 2:217]
The Hukm Shar’i upon you is to stand as one, raising your voices to demand the expulsion of American, not just from Pakistan, but all Muslim countries and mobilize the Muslims in general, and Pakistan’s armed forces in particular, to support their fellow Muslims in Afghanistan, so that the kuffar retreat, defeated and humiliated.
O Ulema of the Muslims in Pakistan! The suffering of the Muslims today in Pakistan and other Muslim countries, the occupation of the Muslim lands, the violation of the sanctities, the assault upon the honour, the looting of wealth and resources, and the hardship in all Muslim countries; these and all other afflictions suffered by the Muslims are the result of the absence of the Islamic state, the Islamic Khilafah, and the absence of the Khaleefah. RasulAllah صلى الله عليه وسلم said,
فالإمام جنة يقاتل من ورائه ويتقى به
“The Imam is a shield, under whom is fighting and by whom is protection”
It is your duty is to join hands with the sincere callers to Islam and establish a second Rightly guided Khilafah state, of whose establishment RasulAllah صلى الله عليه وسلم gave good tiding, which is now well within sight, closer than the blink of an eye, through which the Laws of Allah will be implemented, frontiers and souls will be protected and the scheming of the kuffar will blow up in their faces.
إِنَّ فِى هَـذَا لَبَلَـغاً لِّقَوْمٍ عَـبِدِينَ
“Verily, in this there is a plain Message for people who worship Allah” [Surah Al-Anbiyyah 21:106]
