It is not Permissible in Shariah to Confiscate Newspapers and Muzzle the Mouths except by a Court Order

Since the twenty-sixth of the month of November 2017 and until the date of writing this Press Release, the security agencies have been pursuing various newspapers by confiscating them, including: Akhir Lahdha, Al-Tayyar, Al-Jareedah and Al-Watan have been affected by these confiscations; which are carried out without stated reasons, or a specific charge for the confiscation. These services made themselves an adversary and a judge who simultaneously carry out the punishment, and this is not permissible in the Shariah, and even violates the state’s man-made law constitution and its laws, which causes people to lose confidence and instills gang-style politics and the law of the jungle.

These newspapers are losing huge sums of money, and the efforts of editors, writers and others are futile. This seems to be the intention of the regime in confiscating and damaging the newspapers, so that they will be silent about saying and writing the truth, and to submit to falsehood.

The State of the Muslims; the Khilafah, which adheres to the Book of Allah and the Sunnah of His Messenger ﷺ and the source they refer to, in this regard the Khilafah will:

First: It will not intimidate anyone, and will not control anyone, because it recognizes that it is a servant of the Ummah, and the one that implements Allah’s Law, and listens to advice, and favourably accepts the accounting on the basis of Islam, because the Prophet ﷺ said: «أَفْضَلُ الْجِهَادِ كَلِمَةُ حَقٍّ عِنْدَ سُلْطَانٍ جَائِرٍ» “The best Jihad is the word of truth in front of an oppressive ruler.”

Second: No person shall be punished without a court sentence. In Article 13 of the General Rules in the Draft Constitution of the Khilafah State (on the method of Prophethood) that is adopted by Hizb ut Tahrir it states: “Every individual is innocent until proven guilty. No person shall be punished without a court sentence. Torturing is absolutely forbidden and whoever inflicts torture on anyone shall be punished.”

Third: The state must return the rights to its people, and does not take anything that does not belong to it without a right, as does the man-made system in Sudan and other man-made system. Taking newspapers after printing is to eating people’s money with falsehood and harm that Islam rejects and is punishable. Ibn Abbas said, the Messenger of Allah ﷺ said: «لا ضَرَرَ وَلا ضِرَارَ» “Do not cause harm or return harm.”

We in Hizb ut Tahrir in Wilayah Sudan warn the government against these arbitrary measures to silence the mouths and prevent the word of truth that this may make it stop and learn from history. Neither confiscation nor silencing can conceal the truth. Pharaoh worked hard to kill the children and enslave women so that no child will be born to destroy his rule and remove his authority. But despite this, it was he himself who raised Musa (as) in his palace, so that his destruction is by his own hands!!

We also address the Ummah to work to hold the regime in Sudan accountable and push it to the truth, and above all, to work for radical change with Hizb ut Tahrir to establish the second righteous Khilafah (Caliphate) on the method of Prophethood, which will fill the world with justice and tranquility.

لِمِثْلِ هَذَا فَلْيَعْمَلْ الْعَامِلُونَ

“For the like of this let the workers [on earth] work”

(As-Saffat: 61)
