Implications of the Trial of Sister Zulfiyya Amanova

On 22 August 2014, another court session was held for Sister Zulfiyya Amanova at the regional court in Osh, Kyrgyzstan. The panel of judges comprised of Kubatov Ayler, Mirzabeckov Bolot and Abdyldaev Almaz. The Court retracted her former punishment of a fine in the amount of 50 thousand Soms, issued by Judge Kojomkulov Ramazan on June 1, 2014, and ordered a new punishment in the form of a 1-year suspended imprisonment. The session was delayed because of the repeated postponement as a result of the investigator and experts’ failure to attend. The Judicial session was adjourned eight times since May 13th of last year, which means that they were mocking and ridiculing Zulfiyya and her family.

قَدْ بَدَتِ الْبَغْضَاءُ مِنْ أَفْوَاهِهِمْ وَمَا تُخْفِي صُدُورُهُمْ أَكْبَرُ

“Hatred has already appeared from their Mouths, and what their Breasts Conceal is Greater”

(Al-i-Imran: 118)

In the previous hearing, Prosecutor General Ryskulova Aiem accused our sister Zulfiyya of carrying out extremist activities, and asked the judge to consider her guilty and punish her with a 5-year prison term.

We wonder if this quest to convict sister Zulfiyya and punish her is driven by a personal initiative from the judges and members of the public prosecution, or whether they are orders of the criminal regime in Uzbekistan that previously kidnapped her father the martyr, Amanov Hamidullah, and subjected him to torture for a period of 14 years in prison, and when they could not break his will they brutally killed him? Or is it the new government, which was formed in Kyrgyzstan, which is treading the same path of its neighbours in the fight against Islam and Muslims? That authority which oppresses its people brazenly, the authority that promotes alcohol and life of vice among the people, that authority which drives people to migrate to distant lands for the sake of earning a living, that authority which flexes its muscles on vulnerable women and throws them in prison, and kills their husbands and turn their children into orphans.

We ask you on what basis do you accuse our sister Zulfiyya who fears Allah (swt)!? And on what basis do you imprison our pure and God fearing sisters!? Are you not aware that attacking Muslim women with any harm is gravely prohibited? Allah (swt) warned in His Holy Book of harming the believers, men and women, where He says:

وَالَّذِينَ يُؤْذُونَ الْمُؤْمِنِينَ وَالْمُؤْمِنَاتِ بِغَيْرِ مَا اكْتَسَبُوا فَقَدِ احْتَمَلُوا بُهْتَانًا وَإِثْمًا مُبِينًا

“And those who harm believing men and believing women for [something] other than what they have earned have certainly born upon themselves a slander and manifest sin”

(Al-Ahzab: 58)

We warn you, O judges, prosecutors and you Аtambаev, of the words of Allah (swt):

وَالَّذِينَ يُؤْذُونَ الْمُؤْمِنِينَ وَالْمُؤْمِنَاتِ بِغَيْرِ مَا اكْتَسَبُوا فَقَدِ احْتَمَلُوا بُهْتَانًا وَإِثْمًا مُبِينًا

“And those who harm believing men and believing women for [something] other than what they have earned have certainly born upon themselves a slander and manifest sin.”

(Al-Ahzab: 58)

Our courageous sister Zulfiyya is demanding her right; the return of her father’s dead body, and the punishment of his murderers! This right, which is granted to her by the Almighty Creator! Blood for blood! This position merits all respect.

We ask you! Why didn’t you rise up to your responsibilities and expose the criminals who have betrayed our brother Amanov Hamidullah and allowed his kidnapping!? Why didn’t you demand then the release of our brother Amanov Hamidullah!? When you were in your posts as judges and prosecutors! It is your duty! How can you be satisfied with the silence over someone attacking the dignity of a vulnerable Muslim? How can you not move to protect him?! … The silence over the abuse of the believers, men and women, is a major injustice and a falling into the deep darkness of sin.

Finally, we in Hizb ut Tahrir are confident in the imminent victory of Allah (swt) and the second rightly guided Khilafah State upon the method of Prophethood… A Khilafah that will be brilliant with the light of truth and justice … and then everyone who oppressed the people of this Ummah will stand in its court to receive what he deserves …and it is easy for Allah (swt) to fulfil.

وَيَوْمَئِذٍ يَفْرَحُ الْمُؤْمِنُونَ  بِنَصْرِ اللَّهِ يَنصُرُ مَن يَشَاء وَهُوَ الْعَزِيزُ الرَّحِيمُ

“And that day the believers will rejoice In the victory of Allah. He gives victory to whom He wills, and He is the Exalted in Might, the Merciful”

(Ar-Rum: 4-5)
