Engineer Osman Bakhach, Director of The Central Media Office of Hizb ut Tahrir, participated by delivering a speech via Skype at the conference: “The Role of Scholars in the Establishment of the Khilafah”, held in Jakarta, Indonesia, on Tuesday 18th Dhul Qi’ddah 1434 AH, corresponding to 24th September 2013. The following is the full text of the speech:
بسم الله الرحمن الرحيم
Praise be to Allah, who says in the Holy Book, and His saying is but the truth:
كُنتُمْ خَيْرَ أُمَّةٍ أُخْرِجَتْ لِلنَّاسِ تَأْمُرُونَ بِالْمَعْرُوفِ وَتَنْهَوْنَ عَنِ الْمُنكَرِ وَتُؤْمِنُونَ بِاللّهِ
“You are the best nation ever to be produced before mankind. You enjoin the right, forbid the wrong and have iman in Allah.”
(Ali-Imran, 3:110)
And Peace and Blessings upon the Messenger of Allah, commander of the Mujahideen, who said:
لَتَأْمُرُنَّ بِالْمَعْرُوفِ، وَلَتَنْهَوُنَّ عَنِ الْمُنْكَرِ، وَلَتَأْخُذُنَّ عَلَى يَدِ الظَّالِمِ، وَلَتأْطِرُنَّهُ عَلَى الْحَقِّ أَطْرًا، أَوْ لَيَضْرِبَنَّ اللَّهُ قُلُوبَ بَعْضِكُمْ عَلَى بَعْضٍ، وَلَيَلْعَنَنَّكُمْ كَمَا لَعَنَ بني إسرائيل
“You shall enjoin good and forbid evil, and take on the hand of the oppressor, and instruct him on the framework of truth. Otherwise Allah will strike your hearts against each other and He will curse you like He cursed Bani Israel.” [Narrated by Abu Dawud and At-Tirmidhi]
Dear beloved eminent Scholars gathered in Jakarta in support of this Deen and to uphold the word of Allah, I greet you with the greeting of Islam: Assalamu Alaikum wa Rahmatullahi Wabarakatahu!
It is my pleasure to talk to you, albeit via Skype, after Allah سبحانه وتعالى has blessed us to participate in the Khilafah Conference which you hosted in the last month of Rajab. I saw with my own eyes those dear brothers and sisters who worked day and night for the success of that conference, may Allah reward them with the best reward of this Ummah!
Dear Distinguished Scholars
Oh you whom the Messenger of Allah entrusted with the Amanah of indicating knowledge to the people. He made you his heirs in their education of what they do not know from the provisions of their Deen, as stated in the Hadith narrated by at-Tirmidhi:
… وإن العلماء ورثة الأنبياء
“…the scholars are the heirs of the Prophets”
The people without scholars are ignorant, swayed by the Shayatin of mankind and Jinn, ambushing them from all sides and ravaging them with delusions and their whims from all directions.
Hence, the scholars are from Allah’s blessings upon the people of the earth, they are the lanterns in the darkness and the Imams of guidance. They are Allah’s proof on His earth, through them false thoughts are annihilated and clouds of doubt are dissolved from the hearts and souls. The Messenger of Allah صلى الله عليه وسلم likened them with the stars in his saying:
إن مثل العلماء في الأرض كمثل النجوم يهتدى بها في ظلمات البر والبحر. فإذا انطمست النجوم أو شكت أن تضل الهداة
“The Scholars on earth are like the stars which guide in the darkness of land and sea. If the stars are blurred, the loss of remission comes near.” [Narrated by Ahmad]
In the history of Muslims, there are shining pages upon pages of the positions of splendor and heroism, taken up by the Muslim scholars in the rift to enjoin good and forbid evil, and addressing the injustice of the ruler whenever it occurred during his ruling. They were always the leaders of the Ummah and its guides. The Ummah resorted to them in calamities and hardships to receive knowledge in their Deen from them, contacting them to seek their advice in their important matters, and to lift the injustice of the rulers from the Ummah. The scholars remind the rulers and governors of their Lord.
At times, scholars have been persecuted by the Sultans, and were thrown into prison sometimes, and harm inflicted to their bodies and their money and their dignity at other times. They would endure all of this in recognition of their responsibility before Allah Almighty, engrossed by the words of the Prophet صلى الله عليه وسلم:
سيد الشهداء حمزة ورجل قام إلى إمام جائر فأمره ونهاه فقتله
“The master of Martyrs is Hamza and a man who stood in front of an oppressive ruler and commanded him and forbade him, then he was killed.” [Narrated by Al-Hakim]
Indeed, this was the stand of the scholars in the past. Then came the first European colonization, and the U.S. colonization second. The Kuffar worked to bring about a group which claimed they were “scholars”. In fact they passed rulings according to the cast of the devilish colonialists in their awe from fatwas permitting the falsehood forbidden by Allah, and denying the ordinances enjoined by the Creator. With their fatwas they walked twisted ways to confuse the people in their Deen, and issued fatwas that agreed with the whims of the colonialists of subjecting the Ummah to their governance and ruling it by their pretentious, corrupt, void laws.
I will mention a few incidents:
1. One of them is the fatwa of Muhammad Abduh, supporter of English colonialism in Egypt, known as the Indian Fatwa. When asked whether it is lawful for a Muslim employed with the British to rule by the English laws that are void from what Allah has revealed, after a long answer filled with deviant citations he concluded as a result: “The acceptance of a Muslim to work in the English government in India, and his ruling with their laws is permitted through the section of the principle of committing the lesser of two evils”. He did not stop here but continued to say: “If it were not intended to resolve the support for Islam and keeping the interest of Muslims”. Subhanallah, how did the disobedience to Allah and obedience to the Kaffir occupiers become permissible?!
2. The fatwas of Ibn Baaz, and his likes of the so-called Body of Senior Scholars of the Saudi government, that permitted the seeking of support from Kufr American troops to fight the Iraqi army and expel it from Kuwait in the Gulf War (1990-1991), with all the contradiction of this fatwa with the true saying of Allah سبحانه وتعالى:
ولن يجعل الله للكافرين على المؤمنين سبيلا
“Allah will not give the kuffar any way against the believers.”
(An-Nisa, 4:141)
And for the saying of the Prophet صلى الله عليه وسلم:
لا تستضيئوا بنار المشركين
“Do not light your way with the fire of the Mushrikeen.”
This even comes in contradiction of the Madhab of Muhammad Bin Abdul Wahhab, who considered the manifestation of the Mushrikeen and helping them against the Muslims of the things that contradict the Deen, argumenting with His سبحانه وتعالى saying:
وَمَن يَتَوَلَّهُم مِّنكُمْ فَإِنَّهُ مِنْهُمْ إِنَّ اللَّهَ لاَ يَهْدِي الْقَوْمَ الظَّالِمِينَ
“Any of you who takes them as friends is one of them. Allah does not guide wrongdoing people.”
(Al-Ma’ida, 5:51)
Nevertheless Ibn Baaz and his likes deafened their ears to all this evidence and released the fatwa formulated in the Black House and concocted in Washington. These scholars have loaded themselves with the sin of the Muslim blood spilled in Iraq.
3. Finally, and these examples are not exhaustive, the standing of Sheikh al-Azhar Ahmed al-Tayeb along with General al-Sisi in his coup against the rule of Muhammad Morsi, although the latter did not apply Islam, but was loyal to the Kufr principles of “democratic legitimacy”.
However Sheikh Al-Azhar could not bear a forged democracy led by a bearded President, rather he preferred loyalty to Washington’s politicians by legislating and justifying the overthrow of Muhammad Morsi.
Dear Eminent Scholars
After the Kaffir Western states demolished the Khilafah State in 1924 CE/ 1342 AH, they imposed fragmentation upon the Islamic Ummah, and erected agent rulers who toiled for the application of the provisions of Kufr and ruling the people through oppression and tyranny. So Mustafa Kemal and his fellow rulers took up crusades of campaigns to impose Westernization on Muslims to make them swallow the poison of Kaffir Western civilization, using intimidation and incentives. Whoever accommodated them in their policies was glutted with vanishing worldly joys from positions and profits. Whoever resisted them and insisted to stay on the truth and refute the vice faced abuse in the form of imprisonment and exile, murder and persecution including his family and his supporters and aides from the Muslims. For example, and this is by far not exhaustive, the group of martyrs from the Shabab of Hizb ut Tahrir, who met their Lord while He was satisfied with them – insha Allah – in Russia, Iraq, Tajikistan, and Uzbekistan…
Here is the entire world, witnessing the continuing bloodbath in Syria ash-Sham which Allah has blessed in His Book, and which was described by the Messenger of Allah صلى الله عليه وسلم as:
عُقْرَ دَارِ الإِسْلامِ
“The abode of Islam.”
The people of falsehood from the Kufr countries, and the ones executing their plans from the Muslim rulers in Iran, the Gulf, Turkey and Jordan, make our people in ash-Sham choose: either murder through chemical weapons or murder through explosives, until they agree to the poison of Kufr secularism.
The talk of such abuses is long…
I suffice to salute your blessed gathering, and may Allah make you successful in what He has entrusted you from the Amanah of knowledge, so that you teach people the obligations of their Deen. The first work on this path is the establishment of the Khilafah State, in which they will find their honor and dignity and the pleasure of their Lord.
The observer of what is happening from debates and discussions in the Muslim lands east and west, is aware of the dire need for you to destroy the ideas of Kufr and emphasize the Islamic ideas and lead the people in opposing the plots of the Kaffir states, and uncover the reality of the agents from politicians and intellectuals who mislead Muslims and promote the plots of the enemies. We ask you to put your hands in our hands to call the Ummah to the following:
1. Carry the Da’wah to resume the Islamic way of life through the establishment of the Khilafah state which is the main leadership of the Muslims. It is neither a regional country nor a nationalistic state, rather it is based on the Islamic Aqeedah and the full application of the provisions of Islam interiorly, and carrying the call of Islam to the world to remove it from darkness to the light.
2. Leading the Ummah to take the ruling through intellectual and political struggle, following the method of the Prophet صلى الله عليه وسلم.
3. Not to appease the existing regimes in any form, exposing their plots and revealing their hypocritical policies as well as shattering misleading figures.
4. Our slogan during all of this should be the saying of the Prophet صلى الله عليه وسلم:
والله لو وضعوا الشمس في يميني والقمر في يساري ما تركت هذا الأمر حتى يظهره الله أو أهلك دونه
“By Allah, if they placed the sun in my right and the moon in my left, I would not leave this matter until Allah manifests it or I perish without it.”
We do not doubt for a single moment that Allah سبحانه وتعالى will fulfill His promise to us:
وَعَدَ اللَّهُ الَّذِينَ آمَنُوا مِنْكُمْ وَعَمِلُوا الصَّالِحَاتِ لَيَسْتَخْلِفَنَّهُمْ فِي الْأَرْضِ كَمَا اسْتَخْلَفَ الَّذِينَ مِنْ قَبْلِهِمْ وَلَيُمَكِّنَنَّ لَهُمْ دِينَهُمُ الَّذِي ارْتَضَىٰ لَهُمْ وَلَيُبَدِّلَنَّهُمْ مِنْ بَعْدِ خَوْفِهِمْ أَمْنًا ۚ يَعْبُدُونَنِي لَا يُشْرِكُونَ بِي شَيْئًا ۚ وَمَنْ كَفَرَ بَعْدَ ذَٰلِكَ فَأُولَٰئِكَ هُمُ الْفَاسِقُونَ
“Allah has promised those of you who have iman and do right actions that He will make them successors in the land as He made those before them successors, and will firmly establish for them their deen with which He is pleased and give them, in place of their fear, security. ‘They worship Me, not associating anything with Me.’ Any who are kafir after that, such people are deviators.”
(An-Nur, 24:55)
We ask the Almighty to make us victorious with His Deen and that He gives victory to His Deen through us, sooner than later. He is the Master of that and Able to do so.
