Improvements of Human Trafficking Act is not a solution but widens the barrier of capitalistic nationalism

On 8th June 2015, an article written by Dr. Muzaffar Syah Mallow at Utusan News stated that it is time the Government evaluate and update all the legal provisions to curb the issue of human smuggling and trafficking. Malaysia has completely banned any forms of activities which involves human trafficking and smuggling through the Anti-Trafficking in Persons and Anti-Smuggling of Migrants 2007 (Act 670). This case arose as a result of the influx of Rohingya and Bangladesh refugees who have smuggled into Malaysia.

If referred to Section 2 of Act 670, human trafficking means all acts involving the acquisition or retention of labour or services of a person through compulsion, including the act of recruiting, transporting, transferring, protecting, providing or receiving a person.

Regarding the fact that human trafficking and smuggling activities which are largely taking place in the country’s border areas comprise of a large jungle in the border of Malaysia-Thailand and Malaysia-Kalimantan (Indonesia), the government can consider to widen the enforcement scope to the Malaysian Armed Forces. The writer also suggested that locals should become the eyes and ears of the authorities and be brave as well as immediately report any suspicious activities that occurs around them to the authorities.


 

Comment:

The capitalistic nationalism secular system that shapes and dominates the world today and continues to form a community that highly emphasizes on the colonial invented borders until they have the heart to just leave their brothers and sisters who share the same faith suffer without receiving any proper aid. Smuggling is prohibited not on the basis of awareness towards the brutality of the Bangladesh and Myanmar regime but to guard the border against being smuggled as well as guarding the safety of the community living around the borders. This is the nationalism individualistic lifestyle that has been left by the colonialists to the Muslim Ummah. This act is similar to protecting the predator Myanmar and Bangladesh regime as well as the Muslim puppet regimes that have turned a blind eye towards the sufferings of the Rohingya and Bangladesh Muslims.

Allah سبحانه وتعالى has stated in the Holy Quran:

وَإِنِ اسْتَنصَرُوكُمْ فِي الدِّينِ فَعَلَيْكُمُ النَّصْرُ

 “..And if they seek help of you for the religion, then you must help.”

(Al-Anfal: 72)

The regimes in the Muslim world have disobeyed this particular verse because they have adopted the capitalist system, ruled by the nation-state concept, with a secular view towards citizenship. The borders of a state are narrowed by a nationalist spirit and will only offer help if they have a capitalist interest based on human needs. Under secularism also, the ‘national’ identity is what differentiates citizens and illegal immigrants and this concept is what causes most communities to be abandoned, and drives ethnic and culture conflicts in a country which finally creates wars between countries by ethnic and nation identities.

Therefore, my dear sisters, it is not only the Rohingya and other oppressed people who desperately need an alternative model of governance to protect them from an ill, disunited and corrupt government, but also the whole of humankind in the world. The one and only system that can provide all of this is the Khilafah based on the method of Prophethood which will implement the laws and system of Islam comprehensively. The establishment of this country will undoubtedly be the concrete solution for the tragedy that has occurred our Muslim Rohingya and Bangladesh brothers and sisters, and the global community at a whole.
