Communique to the Respectable Judges and all the Honourable People in Tunisia

After the people came out in Tunisia against the oppression and oppressors five years ago, the people in Tunisia felt that they had become a free people and that their will released after having been burdened with years of repression, prisons and grief. Despite that some of the security personnel are still referring Shabab of Hizb ut Tahrir before those gentlemen (Judges), the delegates of the Republic, under charges like distributing leaflets, carrying the black Rayah (banner) and congregating without a licence or permission and so on…

For this reason, Hizb ut Tahrir in Tunisia issued a communique on the 16th of December 2015 under the title: “Communiqué from Hizb ut Tahrir to the Respectable Judges and all the Honourable People in Tunisia”. This was so that the respected gentlemen judges and the honourable people from amongst the lawyers and journalists would not be flung into partisan polemics or fall into being lured into some political agendas.

The communique contained a reminder of the party’s definition and the foundations upon which it was established and so the following was cited within it: Hizb ut Tahrir is a party that works in politics upon the basis of Islaam which represents the ideology of the Ummah and its identity. And it works to revive it through political struggle and the intellectual struggle and its method in that is the method of the Messenger of Allah by invitation and argumentation upon that which is best without utilising any material action. The Hizb regards the use of material actions as a violation to the method of the Messenger, prayers and peace be upon him, in respect to establishing the Islamic state.

In addition, some legal points were mentioned in the communique and so it went into some of what came in the statement that the Hizb presented to the government on 12/05/2012 within the framework of the organisation of political parties. Included in that which was mentioned was: It was mentioned in the second chapter of the statement of formation that Hizb ut Tahrir is a political party whose ideology is Islam that works to resume the Islamic life and that is via the establishment of the Khilafah (Caliphate) state and carrying the Islamic Da’wah to the world.

It then dealt with a quick reading of the current reality and the work which is obligatory to be undertaken for the purpose of escaping from the noose of colonialization and poorness of life. This is in addition to the necessity of the presence of a movement of complete change by generating a correct intellectual basis upon the basis of which the current prevalent concepts are changed and replaced by the lofty Islamic concepts from which the elevated and distinguished conduct is produced. That would occur via the people as a whole, the rulers and the subjects, the rich and the poor, the educated and illiterate, the judges and soldiers… From there, the Hizb drew the attention of the judges to the Fiqh of the Islamic judiciary and the remainder of the Ahkaam Ash-Shar’iah (Islamic legislative rulings) which are sufficient to make us the best Ummah to be raised up for mankind.
